David Hicks in Guantanamo Bay, his legal situation

Now that the American government has decided that Mamdouh Habib can no longer be held in custody, and has sent him home, there is only one Australian left in Guantanamo Bay - David Hicks. He has been forgotten in recent weeks with all the attention on Habib, but his trial, before a US military commission, is due to begin next month.
The Australian government has ruled out asking for Hicks's release, unlike the British government, which has secured the release of all its 9 detainees.
It says that the problem is that Hicks would walk free if he came back to Australia, because there are no laws to charge him with, but Devika Hovell says that is not the case.
