Mother acquitted of raping daughter

Posted September 5, 2008 16:13:00

The Queensland Court of Appeal has acquitted a woman of raping her own daughter.

The woman, who cannot be named, was convicted in the District Court in Brisbane of one count of digitally raping her daughter between November 2005 and February 2006.

She was sentenced to three-and-a-half years in prison but her conviction was today quashed by the Court of Appeal.

The court found the woman's child, who was eight years old at the time of the alleged offence, gave contradictory evidence and was unable to positively identify her mother as the person who attacked her.
